The Kerala High Court has ordered the demolition and reconstruction of Towers B and C of the Chander Kunj Army Towers at Silver Sand Island, Vyttila, citing severe structural instability.
Court’s Decision on Safety Concerns
Justice Mohammed Nias C P ruled that the deteriorating condition of the towers poses significant risks, leaving demolition and rebuilding as the only option. The court highlighted violations of structural, regulatory, and environmental norms, which led to distress in the buildings.
Formation of Expert Committee
The Ernakulam District Collector has been directed to form a committee that includes:
- A structural engineer
- Two residents’ association representatives
- A municipality engineer
- A town planning officer
The committee must assess the demolition’s impact and ensure minimal disruption to the surroundings.
Compensation and Reconstruction Plan
AWHO must provide compensation to displaced residents, paying ₹21,000 and ₹23,000 per month for alternative housing. The organization is also responsible for covering the ₹175 crore reconstruction cost, with possible insurance claims.
Background of the Issue
Towers B and C, completed in 2018, developed structural issues as early as 2019. Reports from IIT Madras and IISc Bangalore confirmed extensive damage, leading to the court’s decision. The court also instructed authorities to fast-track necessary approvals for demolition and reconstruction.
