The UAE Government has recently introduced a federal decree aimed at regulating media activities within the country. The comprehensive decree covers individuals, organisations, media outlets, and free zones dedicated to media, establishing specific regulations and conditions for ownership and operation.
Defining Media Activities:
The decree outlines media activities as encompassing the production, circulation, printing, and publishing of media content. This includes audio, video, and digital broadcasting, whether provided at a cost or free of charge.
Licensing and Oversight:
A key focus of the law is on the issuance and oversight of licences and permits for executing media activities. It also organises the authorities of the UAE Media Council and local government entities responsible for regulating media affairs.
Compliance Guidelines:
Media individuals and institutions operating in the UAE are required to adhere to national standards for media content. The compliance criteria include:
Respect for Religious and Cultural Sensitivities: Upholding divine respect, Islamic beliefs, and respect for all religions and beliefs.
National Sovereignty and Unity: Respecting the country’s sovereignty, symbols, institutions, and the supreme interests of the UAE and its society.
Alignment with Policies: Respecting the directions and policies of the country on both local and international levels.
Foreign Relations: Avoiding any adverse impact on the UAE’s foreign relations.
Cultural Sensitivity: Respecting the culture, civilization, national identity, and values of the society.
Restrictions on Media Content:
The law prohibits the dissemination of information that may offend national unity or social cohesion. It also restricts content that incites violence, hatred, or propagates discord within society. Additionally, media outlets and individuals are prohibited from showing irresponsible use of the UAE’s legal and economic system, disrespecting privacy rules, and publishing false or misleading news.
Permits for Various Media Forms:
The UAE Media Council is tasked with issuing permits for various forms of media, including the screening of cinematographic productions, books, video games, and advertisements on social media. The Council will also define classifications for the Media Content Rating System and determine age groups suitable for viewing media and entertainment content.
Oversight and Intellectual Property Protection:
The law mandates that licensed individuals and media outlets be subject to oversight and supervision by the competent authority. The UAE Media Council, in collaboration with other authorities, will promote the protection of intellectual property among individuals, establishments, and media institutions in the UAE.
Adjustment Period:
Individuals and media outlets affected by the decree have a twelve-month period to align their operations with its provisions. The Cabinet retains the authority to extend this period if necessary.
